1. Shipping Terms
All shipments are made FCA (Free Carrier), Excellgen shipping point. Title to and risk of loss pass to the customer upon delivery to the carrier.
Excellgen, Inc. shall not be liable for any delay, loss, or damage occurring during shipment, including but not limited to accidents, theft, vandalism, labor disputes, carrier delays, weather conditions, acts of God, or other circumstances beyond our reasonable control.
In the event of verified carrier-related damage or temperature excursion (including delays resulting in loss of dry ice or visible physical damage to packaging), Excellgen will promptly ship a replacement product at no additional charge. Customers must notify Excellgen within seventy-two (72) hours of delivery and provide photographs of the outer packaging, inner packaging, and product condition.
At our sole discretion, Excellgen may issue a product credit or refund for the product value and applicable shipping charges.
2. Taxes and Government Charges
Any use tax, sales tax, excise tax, duty, inspection or testing fee, customs charge, or other governmental fee imposed on or measured by the transaction shall be paid by the customer in addition to the quoted or invoiced prices.
If Excellgen is required to pay any such tax or fee, the customer shall promptly reimburse Excellgen or provide a valid tax exemption certificate at the time the order is submitted.
3. Order Changes and Cancellations
Orders for regularly stocked items may be cancelled without charge provided written notice is received prior to shipment.
Additions or modifications to an order after processing may result in additional freight, handling, and dry ice charges.
Cancellations after shipment but prior to receipt are subject to the restocking fees and terms described below.
Orders for custom products or custom packaging may not be cancelled without the express written consent of Excellgen. “Custom products” or “custom packaging” refers to products manufactured specifically for a customer and not routinely offered for sale to others.
4. Inspection and Claims
Products must be inspected immediately upon receipt.
Our Customer Service Department must be notified in writing of any shortages or shipping damage within seventy-two (72) hours of delivery. Failure to notify within this time period constitutes acceptance of the goods and confirmation that they conform to applicable terms.
All return requests require prior written authorization from Excellgen. A Return Authorization (RA) number must be issued before goods are returned. Unauthorized returns will not be accepted.
5. Defective Product Claims
Claims for defective products must be supported by adequate scientific documentation.
Excellgen does not accept claims based solely on unsuccessful experimental results without appropriate experimental controls, validation data, and written technical details sufficient to evaluate the claim. Products will not be considered defective without objective evidence demonstrating a manufacturing defect.
Excellgen reserves the sole right to determine whether a product is defective.
In certain cases involving verified product defect, Excellgen may require destruction of the product at the customer’s site with written confirmation rather than return shipment.
Replacement of product or issuance of credit, at Excellgen’s discretion, shall be the sole and exclusive remedy for any verified defect.
6. Returns and Restocking Fees
A restocking charge of twenty-five percent (25%) will apply to returns not resulting from Excellgen’s error.
Due to temperature sensitivity and packing requirements, certain products may not be eligible for return.
Authorized returns must arrive at our facilities in resalable condition to qualify for product credit. Goods may not be returned more than ten (10) days after receipt.
Shipping charges are non-refundable.
7. Limitation of Liability
To the fullest extent permitted by law, Excellgen’s liability shall be limited to the replacement value of the product or the purchase price paid.
Excellgen shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of research data, loss of profits, loss of opportunity, or interruption of research activities.
8. Research Use Only
Unless otherwise expressly stated, Excellgen products are sold for research use only and are not intended for diagnostic, therapeutic, or clinical use in humans or animals.
Customers are solely responsible for determining the suitability of the products for their intended use.
